These Terms of Service ("Terms") are a legal agreement between you ("you", "your", or "Traveler") and Travelese ("we", "us", "our", or "Travelese"), operated at travelese.ai and chat.travelese.ai. By creating an account, accessing our platform, or using any of our services, you agree to be bound by these Terms. If you do not agree, do not use Travelese.
1. About Travelese
Travelese is an AI-powered travel planning and booking platform. We provide conversational AI assistance for researching, planning, and booking flights and accommodations. We act as an intermediary between you and third-party travel providers, facilitating bookings through our technology partners.
2. Eligibility
You must be at least 18 years old to create an account or make travel bookings. By using Travelese, you represent that you meet this age requirement.
3. Account Registration
3.1 Creating an Account
To access the full features of Travelese, you must create an account using a valid email address or supported social authentication provider. Authentication is managed through Supabase. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
3.2 Anonymous Access (Demo Mode)
You may use Travelese in a limited demo mode without creating an account. Anonymous users are limited to five (5) AI chat messages. Demo mode does not permit travel bookings or payment transactions. To continue using the platform beyond this limit, you must create an account.
3.3 Traveler Profile
Each registered user must maintain a primary traveler profile containing accurate personal information. This profile is used to process travel bookings on your behalf. You agree to keep your traveler profile information current and accurate at all times.
3.4 Account Security
You must notify us immediately at support@travelese.ai if you believe your account has been compromised. We are not liable for losses resulting from unauthorized use of your account where you have failed to safeguard your credentials.
4. Subscription Plans and Payments
4.1 Subscription Tiers
Travelese offers three subscription tiers:
- Explorer — $9 per month
- Traveler — $19 per month
- Flaneur — $49 per month
Each tier provides different levels of access to AI features, booking capabilities, and usage limits as described on our pricing page. We reserve the right to modify pricing or features with thirty (30) days' notice to active subscribers.
4.2 Payment Processing
All subscription payments are processed through Stripe, a PCI-compliant third-party payment processor. By subscribing, you authorize Stripe to charge your selected payment method on a recurring monthly basis. Travelese does not store your full payment card details on our servers.
4.3 Billing Cycle
Subscriptions begin on the date of purchase and renew automatically each month on the same calendar date. You will be charged at the beginning of each billing cycle.
4.4 Cancellation
You may cancel your subscription at any time through your account settings. Upon cancellation, your subscription remains active until the end of the current billing period. No prorated refunds are issued for partial months. After cancellation takes effect, your account reverts to demo-mode access limits.
4.5 Failed Payments
If a payment fails, we will attempt to charge your payment method again as managed by Stripe's retry logic. If payment cannot be collected after multiple attempts, your subscription may be suspended or downgraded.
5. Travel Bookings
5.1 Travelese as Intermediary
Travelese facilitates travel bookings through Duffel, a travel technology provider that connects to airlines and accommodation providers. When you book a flight or stay through Travelese, you are entering into a contract with the underlying airline or accommodation provider. Travelese is not the travel provider and does not operate flights, hotels, or other travel services.
5.2 Booking Accuracy
You are responsible for verifying all booking details — including traveler names, dates, destinations, passport information, and loyalty program numbers — before confirming a booking. Errors in traveler information may result in denied boarding, booking cancellation, or additional fees imposed by the travel provider, for which Travelese is not responsible.
5.3 Pricing and Fees
Travel prices displayed through Travelese are sourced from Duffel and the underlying travel providers. Prices may change between the time they are displayed and the time you confirm a booking. The final price is the amount confirmed at the time of booking completion. Travelese may apply a service margin to bookings, which is included in the displayed price.
5.4 Booking Payments
Payments for travel bookings are processed through Duffel's payment infrastructure. By confirming a booking, you authorize the applicable charge to your payment method. Travel booking payments are separate from your subscription payments.
5.5 Cancellations, Changes, and Refunds
Cancellation and change policies are determined by the underlying airline or accommodation provider, not by Travelese. Refund eligibility, change fees, and cancellation penalties are governed by the travel provider's terms. We will make reasonable efforts to assist you with cancellation or change requests, but we cannot guarantee outcomes that depend on third-party provider policies.
5.6 Travel Documentation
You are solely responsible for ensuring you have valid passports, visas, health documentation, and any other travel documents required for your trip. Travelese does not verify the validity of your travel documents or your eligibility to travel to any destination.
6. AI Services
6.1 AI Chat
Travelese provides AI-powered conversational assistance for travel planning, powered by xAI's language models. AI responses are generated based on available data and algorithms and may not always be accurate, complete, or up to date. You should independently verify critical information such as visa requirements, health advisories, and travel restrictions.
6.2 Voice Features
Travelese offers voice interaction capabilities, including voice input and text-to-speech output through AI voice personas (Eve, Ara, Rex, Sal, and Leo). When you use voice features:
- Voice input is processed to convert your speech into text for the AI to respond to.
- Voice data is processed in real time and is not permanently stored as audio recordings by Travelese.
- Text-to-speech output is generated using xAI's voice synthesis technology.
By using voice features, you consent to the processing of your voice input as described above and in our Privacy Policy.
6.3 AI Limitations
AI-generated content, including travel recommendations, pricing information, and itinerary suggestions, is provided for informational purposes. Travelese does not guarantee the accuracy, completeness, or suitability of AI-generated content. The AI may occasionally produce errors, outdated information, or responses that do not fully address your needs. You agree not to rely solely on AI output for decisions involving safety, legal compliance, or significant financial commitment without independent verification.
6.4 Chat History
Your chat messages and AI responses are stored to provide conversation continuity, improve the service, and enable you to reference past interactions. Chat data is associated with your account and subject to our data retention practices described in our Privacy Policy.
7. Acceptable Use
You agree not to:
- Use Travelese for any unlawful purpose or in violation of any applicable law or regulation.
- Provide false or misleading information in your traveler profile or during the booking process.
- Attempt to gain unauthorized access to our systems, other user accounts, or third-party services connected to Travelese.
- Interfere with or disrupt the operation of the platform, including through automated scripts, bots, or excessive API requests.
- Resell, redistribute, or commercially exploit Travelese's services without our written permission.
- Use AI features to generate content that is harmful, abusive, threatening, or that violates the rights of others.
- Circumvent usage limits, subscription restrictions, or security measures.
We reserve the right to suspend or terminate your account for violations of these terms, with or without prior notice.
8. Intellectual Property
All content, software, design, branding, and technology comprising Travelese — including but not limited to the AI models, user interface, and documentation — is owned by or licensed to Travelese and is protected by applicable intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the platform for personal, non-commercial travel planning purposes.
Content you create or provide through Travelese (such as notes, preferences, and traveler information) remains yours. By submitting content to Travelese, you grant us a limited license to use that content to provide and improve our services.
9. Third-Party Services
Travelese integrates with third-party services to deliver its functionality. Your use of Travelese involves interaction with:
- Supabase — Authentication and data storage
- Stripe — Subscription payment processing
- Duffel — Travel booking and fulfillment
- xAI — AI language model and voice synthesis
Each third-party service is governed by its own terms and privacy policies. Travelese is not responsible for the practices, availability, or performance of third-party services. We are not liable for any loss or damage resulting from the acts or omissions of these third-party providers.
10. Limitation of Liability
To the maximum extent permitted by applicable law:
- Travelese is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory.
- We do not warrant that the platform will be uninterrupted, error-free, secure, or that AI-generated content will be accurate.
- Travelese shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, travel plans, or business opportunities.
- Our total aggregate liability to you for any claims arising from or related to these Terms or your use of Travelese shall not exceed the amount you paid to Travelese in subscription fees during the twelve (12) months preceding the claim.
- We are not liable for losses arising from travel disruptions, cancellations, or changes made by airlines, accommodation providers, or other third parties.
11. Indemnification
You agree to indemnify, defend, and hold harmless Travelese, its officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the platform, your violation of these Terms, or your violation of any rights of a third party.
12. Data Retention
We retain your account data, traveler profiles, chat history, and booking records for as long as your account is active and for a reasonable period thereafter for legal, operational, and compliance purposes. You may request deletion of your account and associated data as described in our Privacy Policy, subject to our legal retention obligations.
13. Modifications to These Terms
We may update these Terms at any time. Material changes will be communicated to registered users via email or an in-app notification at least thirty (30) days before they take effect. Your continued use of Travelese after changes take effect constitutes acceptance of the updated Terms. If you do not agree with the changes, you must stop using the platform and cancel your subscription.
14. Termination
We may suspend or terminate your account at our discretion if you breach these Terms, engage in fraudulent activity, or if required by law. Upon termination, your right to access Travelese ceases immediately. Provisions of these Terms that by their nature should survive termination (including sections on limitation of liability, indemnification, and governing law) shall continue in effect.
15. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising from or related to these Terms or your use of Travelese shall be resolved through binding arbitration administered by a recognized arbitration body, except where prohibited by law. Nothing in these Terms limits your rights under mandatory consumer protection laws of your jurisdiction of residence.
16. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
17. Entire Agreement
These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Travelese regarding your use of the platform. They supersede any prior agreements or understandings, whether written or oral.
